Appendix

Article 35 of the French Data Protection Act no. 78-17 of January 6, 1978, as amended by Act no. 2004-801 of August 6, 2004.

Personal data may only be processed by a processor, a person acting under the authority of the controller or the processor, on the instructions of the controller.

Any person processing personal data on behalf of the controller is considered a processor within the meaning of this law.

The processor must provide sufficient guarantees to ensure the implementation of the security and confidentiality measures mentioned in article 34. This requirement does not relieve the data controller of its obligation to ensure compliance with these measures.

The contract binding the processor to the data controller shall specify the obligations incumbent on the processor with regard to the protection of data security and confidentiality, and shall stipulate that the processor may only act on instructions from the data controller.
